Abstract:
Emerging technologies brought a dramatic change in speed regarding industrial affairs, economy, and society. Indeed, it was these rapid transformations, made faster and further such technology, that made it real-time accomplishments of modern emerging technologies, including artificial intelligence, blockchain technologies, biotechnology, and quantum computing. Intellectual Property Rights (IPR), on the other hand, forms an important pillar that supports innovations and their relative protection among creators or innovators in this domain. These old characteristics, however, pose an unending challenge to the existing IPR laws concerning what might pose a threat to these technologies, requiring very available adaptation and innovation in the legal facets as well as policy and enforcement frameworks. For example, this article brings out on IPR emergence and technology as it delves into core issues of patentability, copyright, ownership of data as well as issues to do with cross-border enforcement. It will also consider how your traditional IPR regime adapts to address issues of patenting AI-generated inventions, ownership ambiguities regarding collaborative technologies, and the international dimension of much of the digital intellectual property. The article touches on avenues for stimulating innovation through more inclusive and technology-oriented IPR policies such as open-source approaches, faster patent processing, and harmonization of international IP laws. Case study and ongoing policy initiatives assessment will therefore provide insights for striking a balance between protection of innovation and accessibility and equitable use in the emerging technologies era. It states that IPR strategy of change instead needs to be dynamic and future-oriented in that sustainable technological development is supported even as their rights and, to an extent, their incentives would be granted to innovators in an increasingly interconnected and digital world.
